Jack Smith is FINISHED

Online rumors are swirling that Biden Justice Department special counsel Jack Smith may be relying on a perforated legal strategy lacking attention to detail that will fail under judicial scrutiny and may result in a significant portion of the case being tossed as pressure mounts on Smith to deliver a crushing blow in his classified documents case against former President Donald Trump.

According to documents that were revealed as part of the prosecution’s case against the former president, according to investigative journalist Paul Sperry of RealClearInvestigations, Smith is using “inflammatory language” in order to “appeal emotionally to jurors” rather than actual evidence. “Fraud/fraudulent,” used 63 times, “false/falsely,” used 94 times, “fake,” and “sham” are among the words Smith lists in the January 6th indictment.

Some of Sperry’s citations are related to Smith’s allegation that President Trump’s reliance on the Presidential Records Act is “false” since the documents he claimed to declassify included carefully held secrets and should be covered by the Espionage Act. The Republican leader may receive a lengthy prison term if proven guilty of selling top-secret secrets.

Sperry adds that given that Trump was not questioned by a federal agent during an FBI raid at Mar-a-Lago to recover the sensitive information, additional charges relating to the president making false statements will probably be dropped.

The usage of an emoji in an email between people at Mar-a-Lago that discusses the security footage that was partially deleted before the raid is possibly Smith’s weakest defense. Sperry contends that the precise material mentioned in this email was not erased, therefore if the email had an image of a wastepaper basket, for instance, a judge would not be able to infer that it referred to footage that was eventually saved.

The case won’t start until May of next year, according to Judge Aileen Cannon, who was chosen by President Trump. This decision will keep the case in the public eye until the crunch of the 2020 election. The former president’s attorneys have stated that they intend to ask for the case to be completely dismissed due to prosecutorial misconduct. Alina Habba, a well-known Trump supporter, has used the instance of FBI agents ordering Mar-a-Lago staff to turn off security cameras during the raid to support her claim that prosecutors have tried to persuade grand juries that Trump is guilty simply for exercising his right to privileged attorney-client communications.

Smith hinted that he intended to charge Trump with violating the 1917 Espionage Act by claiming the stolen documents pose hazards to national security and contained private knowledge regarding the American military’s readiness and nuclear weapons. The case has been referred to by President Trump as another instance of “political hit jobs” carried out by Smith. Smith has a history of bringing unsuccessful prosecutions against politicians, including former Virginia Governor Bob McDonnell, whose guilty judgment on bribery charges was later overturned by the Supreme Court.
